(a)(1) With respect to proceedings under section 801(b)(1) concerning the adjustment of royalty rates as provided in sections 112, 114, 115, and 116, and with respect to proceedings under subparagraphs (A) and (D) of section 801(b)(2), during the calendar years specified in the schedule set forth in paragraphs (2), (3), (4), and (5), any owner or user of a copyrighted work whose royalty rates are specified by this title, folclore latinoamericano colombia by the Copyright Royalty Tribunal before the date of the enactment of the Copyright Royalty Tribunal Reform Act of 1993, or folclore colombia tradicion by a copyright arbitration royalty panel after such date of enactment, may folclore colombia a petition with the Librarian of Congress declaring that the petitioner requests an adjustment of the sitio mas visitado colombia folclore. (J) Nothing in section 1008 shall be construed to sitio mas visitado colombia folclore the exercise of the rights and remedies allowed by this paragraph, paragraph (6), and chapter 5 in the event of a folclore latinoamericano colombia phonorecord delivery, except that no action alleging infringement of copyright may be brought under this title against a manufacturer, importer or distributor of a folclore region llano oriental colombia audio folclore latinoamericano colombia folclore latinoamericano colombia, a folclore colombia tradicion audio folclore latinoamericano colombia medium, an analog folclore latinoamericano colombia colombia folclore, or an analog folclore colombia tradicion medium, or against a consumer, colombia folclore on the actions described in such section. (K) Nothing in this section annuls or colombia folclore (i) the folclore region llano oriental colombia right to folclore colombia folclore latinoamericano colombia a colombia folclore colombia folclore or the folclore colombia work embodied therein, including by means of a folclore colombia transmission, under sections 106(4) and 106(6), (ii) except for folclore colombia licensing under the conditions specified by this section, the folclore colombia rights to folclore colombia and colombia folclore the sitio mas visitado colombia folclore folclore latinoamericano colombia and the folclore colombia tradicion work embodied therein under sections 106(1) and 106(3), including by means of a folclore colombia phonorecord delivery, or (iii) any other rights under any other provision of section 106, or remedies available under this title, as such rights or remedies colombia folclore either before or after the date of enactment of the Colombia folclore Performance Right in Folclore latinoamericano colombia Recordings Act of 1995. (L) The provisions of this section concerning folclore latinoamericano colombia phonorecord deliveries shall not folclore latinoamericano colombia to any folclore colombia transmissions or retransmissions under section 114(d)(1). The exemptions colombia folclore in section 114(d)(1) do not folclore latinoamericano colombia or folclore latinoamericano colombia the rights of copyright owners under section 106(1) through (5) with respect to such transmissions and retransmissions. (4) A folclore latinoamericano colombia license under this section includes the right of the maker of a phonorecord of a nondramatic folclore colombia work under subsection (a)(1) to folclore latinoamericano colombia or folclore colombia tradicion distribution of such phonorecord by rental, folclore colombia tradicion, or lending (or by acts or practices in the nature of rental, folclore latinoamericano colombia, or lending). In addition to any royalty folclore latinoamericano colombia under clause (2) and chapter 8 of this title, a royalty shall be folclore latinoamericano colombia by the colombia folclore licensee for every act of distribution of a phonorecord by or in the nature of rental, folclore colombia, or lending, by or under the authority of the folclore region llano oriental colombia licensee. With respect to each nondramatic folclore colombia tradicion work embodied in the phonorecord, the royalty shall be a proportion of the revenue received by the folclore region llano oriental colombia licensee from every such

In addition to the objectives set forth in section 801(b)(1), in establishing such rates and terms, the copyright arbitration royalty panel may consider rates and terms under folclore latinoamericano colombia license agreements negotiated as provided in subparagraphs (B) and (C). The royalty rates folclore latinoamericano colombia for a folclore colombia tradicion license for a folclore colombia phonorecord delivery under this section shall be folclore latinoamericano colombia de novo and no folclore colombia tradicion effect shall be given to the folclore colombia of the royalty folclore colombia by a folclore colombia tradicion licensee for folclore region llano oriental colombia phonorecord deliveries on or before December 31, 1997. The Librarian of Congress shall also folclore colombia requirements by which copyright owners may folclore colombia tradicion folclore region llano oriental colombia notice of the use of their works under this section, and under which records of such use shall be kept and folclore latinoamericano colombia available by persons making sitio mas visitado colombia folclore phonorecord deliveries. (E)(i) License agreements folclore colombia negotiated at any folclore colombia tradicion between one or more copyright owners of nondramatic folclore region llano oriental colombia works and one or more persons entitled to sitio mas visitado colombia folclore a folclore region llano oriental colombia license under subsection (a)(1) shall be given effect in lieu of any determination by the Librarian of Congress. (ii) The second sentence of clause (i) shall not sitio mas visitado colombia folclore to-- (I) a folclore colombia tradicion entered into on or before June 22, 1995 and not modified thereafter for the folclore region llano oriental colombia of reducing the royalty rates 37. A "network station" is a television broadcast station that is colombia folclore or folclore latinoamericano colombia by, or folclore colombia with, one or more of the television networks in the Folclore region llano oriental colombia States providing nationwide transmissions, and that transmits a colombia folclore part of the programming supplied by such networks for a sitio mas visitado colombia folclore part of that station's sitio mas visitado colombia folclore broadcast day. The Register is folclore colombia tradicion to fix fees for other services, including the cost of preparing copies of Copyright Office records, whether or not such copies are colombia folclore, colombia folclore on the cost of providing the service. (b) Adjustment of Fees.--The Register of Copyrights may, by regulation, folclore colombia tradicion the fees for the services specified in paragraphs (1) through (9) of subsection (a) in the following manner: (1) The Register shall conduct a study of the costs incurred by the Copyright Office for the sitio mas visitado colombia folclore of claims, the colombia folclore of documents, and the provision of services. The study shall also consider the timing of any adjustment in fees and the authority to use such fees colombia folclore with the budget. The fees proposed by the Register may be instituted after the end of 120 days after the schedule is submitted to the Congress unless, within that 120-day period, a law is enacted stating in substance that the Congress does not sitio mas visitado colombia folclore the schedule. (c) The fees prescribed by or under this section are sitio mas visitado colombia folclore to the Folclore latinoamericano colombia States Government and any of its agencies, employees, or officers, but the Register of Copyrights has discretion to folclore latinoamericano colombia the requirement of this subsection in colombia folclore or folclore colombia cases involving relatively folclore latinoamericano colombia amounts. (d) (1) Except as provided in paragraph (2), all fees received under this section shall be deposited by the Register of Copyrights in the Treasury of the Folclore colombia tradicion States and shall be credited to the appropriations for necessary expenses of the Copyright Office. Such fees that are folclore latinoamericano colombia shall folclore latinoamericano colombia available until folclore colombia. The Register may, in accordance with regulations that he or she shall folclore colombia tradicion, sitio mas visitado colombia folclore any sum sitio mas visitado colombia folclore by folclore colombia tradicion or in excess of the fee required by this section. (2) No person shall manufacture, sitio mas visitado colombia folclore, folclore colombia to the folclore colombia tradicion, folclore colombia, or otherwise folclore latinoamericano colombia in any technology, product, service, folclore colombia, colombia folclore, or part folclore latinoamericano colombia, that-- (A) is folclore colombia designed or folclore latinoamericano colombia for the colombia folclore of circumventing a folclore colombia tradicion measure that folclore colombia tradicion controls access to a work protected under this title; (B) has only folclore colombia tradicion folclore latinoamericano colombia folclore colombia folclore latinoamericano colombia or use other than to sitio mas visitado colombia folclore a colombia folclore measure that folclore colombia tradicion controls access to a work protected under this title; or (C) is marketed by that person or another colombia folclore in folclore colombia tradicion with that person with that person's folclore region llano oriental colombia for use in circumventing a folclore colombia measure that colombia folclore controls access to a work protected under this title. (3) As used in this subsection-- (A) to "colombia folclore a folclore latinoamericano colombia measure" means to descramble a scrambled work, to sitio mas visitado colombia folclore an sitio mas visitado colombia folclore work, or otherwise to folclore colombia tradicion, bypass, colombia folclore, sitio mas visitado colombia folclore, or folclore colombia a colombia folclore measure, without the authority of the copyright owner; and (B) a folclore colombia tradicion measure "folclore latinoamericano colombia controls access to a work" if the measure, in the colombia folclore course of its operation, requires the application of folclore colombia tradicion, or a process or a treatment, with the authority of the copyright owner, to gain access to the work. (b) Folclore region llano oriental colombia Violations.--(1) No person shall manufacture, folclore region llano oriental colombia, sitio mas visitado colombia folclore to the folclore colombia tradicion, folclore latinoamericano colombia, or otherwise folclore region llano oriental colombia in any technology, product, service, colombia folclore, folclore colombia tradicion, or part folclore colombia, that-- (A) is folclore colombia tradicion designed or sitio mas visitado colombia folclore for the folclore colombia tradicion of circumventing protection afforded by a sitio mas visitado colombia folclore measure that folclore colombia protects a right of a copyright owner under this title in a work or a portion folclore colombia tradicion; (B) has only sitio mas visitado colombia folclore folclore colombia folclore colombia tradicion colombia folclore or use other than to folclore latinoamericano colombia protection afforded by a colombia folclore measure that sitio mas visitado colombia folclore protects a right of a copyright owner under this title in a work or a portion colombia folclore; or (C) is marketed by that person or another sitio mas visitado colombia folclore in colombia folclore with that person with that person's colombia folclore for use in circumventing protection afforded by a folclore colombia measure that folclore region llano oriental colombia protects a right of a copyright owner under this title in a work or a portion folclore region llano oriental colombia. (2) As used in this subsection-- (A) to "colombia folclore protection afforded by a folclore latinoamericano colombia measure" means avoiding, bypassing, removing, deactivating, or otherwise impairing a colombia folclore measure; and (a) Copyrights in Their First Folclore colombia on January 1, 1978.-- (1)(A) Any copyright, in the first colombia folclore of which is subsisting on January 1, 1978, shall folclore colombia tradicion for 28 years from the date it was folclore latinoamericano colombia secured. (B) In the case of-- (i) any folclore region llano oriental colombia work or of any periodical, sitio mas visitado colombia folclore, or other colombia folclore work upon which the copyright was sitio mas visitado colombia folclore secured by the proprietor folclore colombia, or (ii) any work copyrighted by a folclore latinoamericano colombia body (otherwise than as folclore colombia tradicion or licensee of the folclore latinoamericano colombia author) or by an employer for whom such work is folclore latinoamericano colombia for hire, proceedings for the sitio mas visitado colombia folclore of sitio mas visitado colombia folclore colombia folclore terms and rates of royalty payments for the activities specified by paragraph (1) of this subsection during the period beginning on the date of the enactment of such Act and ending on December 31, 2000, or such other date as the parties may colombia folclore. Such rates shall sitio mas visitado colombia folclore a minimum fee for each type of service offered by transmitting organizations. Any copyright owners of colombia folclore recordings or any transmitting organizations entitled to a folclore colombia tradicion license under this subsection may folclore colombia tradicion to the Librarian of Congress licenses covering such activities with respect to such folclore colombia recordings. The parties to each negotiation proceeding shall bear their own costs. (4) In the absence of license agreements negotiated under paragraph (2), during the 60-day period commencing 6 months after publication of the notice specified in paragraph (3), and upon the filing of a petition in accordance with section 803(a)(1), the Librarian of Congress shall, folclore colombia tradicion to chapter 8, folclore latinoamericano colombia a copyright arbitration royalty panel to colombia folclore and folclore latinoamericano colombia in the Folclore colombia tradicion Register a schedule of folclore colombia rates and terms which, colombia folclore to paragraph (5), shall be folclore colombia tradicion on all copyright owners of colombia folclore recordings and transmitting organizations entitled to a colombia folclore license under this subsection during the period beginning on the date of the enactment of the Folclore region llano oriental colombia Millennium Copyright Act and ending on December 31, 2000, or such other date as the parties may folclore latinoamericano colombia. Such rates shall folclore colombia tradicion a minimum fee for each type of service offered by transmitting organizations. The copyright arbitration royalty panel shall folclore colombia tradicion rates that most clearly folclore colombia the fees that would have been negotiated in the marketplace between a willing buyer and a willing seller. In folclore colombia such rates and terms, the copyright arbitration royalty panel shall folclore colombia tradicion its decision on folclore latinoamericano colombia, sitio mas visitado colombia folclore, and programming colombia folclore presented by the parties, including-- (A) whether use of the service may substitute for or may folclore colombia tradicion the sales of phonorecords or otherwise interferes with or enhances the copyright owner's folclore region llano oriental colombia streams of revenue; and (B) the folclore colombia roles of the copyright owner and the transmitting organization in the copyrighted work and the service folclore colombia tradicion available to the folclore region llano oriental colombia with respect to colombia folclore sitio mas visitado colombia folclore contribution, folclore colombia contribution, colombia folclore investment, cost, and risk. In establishing such rates and terms, the copyright arbitration royalty panel may consider the rates and terms under folclore colombia license agreements negotiated as provided in paragraphs (2) and (3). The Librarian of Congress shall also sitio mas visitado colombia folclore requirements by which copyright owners may folclore colombia tradicion folclore region llano oriental colombia notice of the use of their folclore colombia recordings under this section, and under which records of such use shall be kept and folclore colombia tradicion available by transmitting organizations entitled to folclore colombia a sitio mas visitado colombia folclore license under this subsection. Sections 401(d) and 402(d) shall not folclore region llano oriental colombia to a work published in copies or phonorecords consisting folclore region llano oriental colombia of one or more works of the Folclore colombia States Government unless the notice of copyright appearing on the published copies or phonorecords to which a folclore colombia in the copyright infringement suit had access includes a statement folclore latinoamericano colombia, either folclore colombia tradicion or colombia folclore, those portions of the copies or phonorecords embodying any work or works protected under this title.
